On 15 May 2012, the Supreme Court of Appeal will hear arguments in the case of Aventis Pharma SA and Others v Cipla Life Sciences and Others in the patent dispute over the cancer medicine Docetaxel (brand name Taxotere). The Treatment Action Campaign (TAC) has been admitted to the proceedings as amicus curiae (friend of the court) and is represented by SECTION27. TAC will argue for the protection of the rights of people in need of medicines in disputes of this nature.

Statement by the Treatment Action Campaign, the HIV Clinicians Society of Southern Africa, the Rural Health Advocacy Project, the Rural Doctors Association of Southern Africa, SECTION27 and Médecins Sans Frontières

There have been ongoing shortages of antiretroviral medicines, specifically tenofovir (TDF) and abacavir (ABC) since March in facilities across South Africa. The TAC National Council has resolved to seek admission in a legal dispute between the brand name drug company Aventis Pharma and the generic company Cipla, over a claim of patent infringement on a drug that treats cancer called Docetaxel. SECTION27 will act as attorneys for TAC. This briefing note sets out the background to the legal dispute and explains why TAC is arguing that the Supreme Court of Appeal must consider the right of access to health care services when it judges this dispute.

On Friday 16 March 2012 health workers, counselling organisations, activists and the National Department of Health met in Hillbrow to discuss how to improve HIV testing and counselling.
